2. Applicable law

The sale of products and services by electronic means is governed by articles 45 to 67 "Consumer Rights" of Legislative Decree 6 September 2005 n. 206 (Consumer Code) and by Legislative Decree 21 February 2014 n. 21 in the field of electronic commerce. The sales contract stipulated between the Customer and ARTEX by GREEN LINE S.r.l. will be regulated and interpreted in accordance with Italian law. All distance contracts relating to the sale of goods stipulated between ARTEX by GREEN LINE S.r.l. and the customer will be governed exclusively by the following General Terms and Conditions. In addition to any other term or expression defined herein, the following terms and expressions will take on the following meaning: consumer ": any natural person who purchases (or accepts to buy) goods from ARTEX by GREEN LINE Srl, through the online FILATITALIA.COM store for purposes unrelated to one's business, commercial or professional activity. Therefore ARTEX by GREEN LINE S.r.l. invites you to read these general conditions of sale carefully, to print them or in any case to keep a copy.

4. How to purchase

The customer can purchase the products visible at https://www.filatitalia.com/ illustrated on the homepage of the Website of the respective sections by product category, as shown in the relevant information sheets. The products published on the website can be: "available", or rather physically in stock and therefore, as such, ready for shipment or temporarily "unavailable" for supply not completed. In this case the product can be ordered by the customer, but will have to wait several days for delivery. In order to make purchases, the Customer must be registered on the Site. When the purchase is made, the Customer has the possibility to choose the Payment Method he prefers. The acceptance of the order by ARTEX by GREEN LINE S.r.l. is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Customer upon registration to the Site. ARTEX by GREEN LINE S.r.l. reserves the right, at its sole discretion, not to accept the order. The Customer undertakes to verify the correctness of the data present in the order confirmation email and to promptly report to ARTEX by GREEN LINE S.r.l. any errors or omissions. The order confirmation email contains the following data: Order number and date Product / s, quantity, price Type of payment chosen Transport Cost Total order amount.

5. Caution

   For shipments in tax-free areas of the Italian territory in the municipalities of Livigno, Campione d'Italia and the Italian waters of Lake Lugano, smaller islands etc. the shipping price will be calculated automatically based on the post code, for doubts you can call 0733/850112 or send an e-mail to info@filatitalia.com.

6. Price

8. Delivery

ARTEX by GREEN LINE S.r.l. only accept orders that provide delivery on the Italian and foreign territory. ARTEX by GREEN LINE S.r.l. confirms the acceptance of the order by sending an automatic summary e-mail to the e-mail address indicated by the Customer in the same order. ARTEX by GREEN LINE S.r.l. prepares the goods contained in the order and entrusts them to the Courier with the original packaging or with cardboard boxes properly sealed with tape. The term of entrustment to the courier varies according to the method of payment chosen and the availability of the product: Credit card and PayPal: acquired orders within 1.00 pm on Working Days are entrusted to the Courier within two working days after receipt of payment by ARTEX by GREEN LINE S.r.l .. Bank Transfer: an average of 3/5 Business Days pass from the availability of the bank transfer before the amount is credited to the current account of ARTEX by GREEN LINE Srl. All orders are entrusted to the Courier within two working days following receipt of payment by of ARTEX by GREEN LINE Srl. Deliveries are made on working days, from Monday to Friday, except holidays (hereinafter "Working Day (s)"). By Hours we mean the hours included in Working Days. All orders are entrusted to the Courier: Delivery times of the Courier to the Customer's home are approximately 1-2 days in Northern and Central Italy, 2-3 in Southern Italy and 4-5 days abroad, they are still to be considered indicative as they may undergo variations due to causes of force majeure, due to difficult traffic and road conditions, for strikes or by the Authority. With the shipment of the package, we also send an email with the traceability code to follow your order in every movement! Check the status of your order, at any time! Through the traceability code that you will receive by email when the package is shipped, it will be possible to know the status and the route! If you have not received the email check in the spam, because sometimes it ends there! In rare cases, tracking is unfortunately not possible. If you have not received any package within 3-4 days of shipment from us, we recommend checking its status with the traceability code. 9. Shipping costs

EUROPEAN UNION: For all the other countries of the European Union, the customer will have the possibility of withdrawal with his courier, or he will arrange ARTEX by GREEN LINE S.r.l. at the customer's expense based on the price per weight that will appear at point 4 (SHIPMENT) of the Cart when ordering. When the amount of the order exceeds € 200 of taxable goods, the shipment will be free for the customer. ITALY AND ISLANDS: ARTEX by GREEN LINE S.r.l. will provide to the shipment with our GLS courier based on the price per weight that will appear at point 4 (SHIPMENT) of the Cart when ordering. When the order amount exceeds € 100 of the taxable amount of the goods, the shipment will be free for the customer. Any additional shipping and packaging costs incurred due to partial deliveries will be charged to ARTEX by GREEN LINE S.r.l .. In the event that ARTEX of GREEN LINE S.r.l. does not comply with the expected delivery terms, the customer will have the right to terminate the contract only if a reasonable period has passed without execution by ARTEX by GREEN LINE S.r.l.. ARTEX by GREEN LINE S.r.l. will have the right to terminate the sales contract in the event that one of its suppliers violates its contractual obligation and does not provide ARTEX by GREEN LINE S.r.l. the goods ordered according to the provisions of this contract. In this case, ARTEX by GREEN LINE S.r.l. will promptly inform the customer of the non-availability of the ordered goods and will promptly reimburse any payments already made by the customer. It's implied that, if the customer is a consumer, these payments must be reimbursed by ARTEX by GREEN LINE S.r.l. no later than 30 (thirty) days from the date the order is placed by the customer.

10. Right of withdrawal

Sales of products via the Internet are governed by articles 45 to 67 of Legislative Decree 21/2014 (Consumer Code). This legislation provides for the consumer the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred. Procedures and times for exercising the right of withdrawal The Customer has the right to withdraw from the order made, without having to provide any reasons, within 14 days from the day he received the ordered product. Within 14 (fourteen) days of receipt of the Return Authorization Number (NAR), the Customer will, at his / her own expense, ship the carefully packaged product, indicating the Return Authorization Number (NAR) assigned by ARTEX by GREEN LINE Srl, at the following address: ARTEX by GREEN LINE S.r.l. The deadline is considered to be met if the Customer sends the product before the period of 14 (fourteen) days expires. Methods and times for reimbursement to the Customer of the product cost and shipping costs. Pursuant to Article 56 of Legislative Decree 21/2014 ARTEX by GREEN LINE S.r.l. will reimburse all payments within 14 (fourteen) days from the date in which it became aware of the Customer's right of withdrawal, including delivery costs (except for the additional costs deriving from the possible choice of a delivery type different from the least expensive standard delivery type offered by ARTEX by GREEN LINE Srl) In any case, the Customer will not incur any costs as a result of such reimbursement. ARTEX by GREEN LINE S.r.l. he may withhold the reimbursement until he has received the whole product or until the Customer has demonstrated that he has sent back the goods, depending on which situation occurs first. For purchases made with one of the following payment methods: • cash on delivery • wire transfer ARTEX by GREEN LINE S.r.l. will reimburse by bank transfer. For purchases made by credit card payment, the refund will be made by transferring the transaction directly to the credit card. For purchases made through PayPal payment the refund will be made by crediting the Customer's account. If the returned items show damage or signs of wear resulting from unnecessary manipulation to establish the nature, characteristics and functioning of the same, we will be able to withhold an amount corresponding to their decrease in value from the refund. 11. Legal guarantee

Pursuant to Legislative Decree 206/2005 ("Consumer Code") all products on sale on the site are covered by the 24-month Legal Guarantee. Based on the 24-month Legal Guarantee ARTEX by GREEN LINE S.r.l. is liable to the consumer (the natural person who acts for purposes unrelated to the entrepreneurial, commercial, artisanal or professional activity carried out) for the lack of conformity not found at the time of purchase. The lack of conformity exists when the product is not suitable for the use to which it normally serves, does not conform to the description or does not possess the qualities promised by the seller, does not offer the usual qualities and performance of a good of the same type, does not is suitable for the particular use intended by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (Article 129 of the Consumer Code). The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months following the date of discovery of the defect. ARTEX by GREEN LINE S.r.l. will remedy quality defects within a reasonable period of time (subsequent execution) eliminating the defect (repair) or delivering goods without defects (replacement). In the event of a subsequent non-execution or that this is not acceptable to the customer or is rejected by ARTEX by GREEN LINE Srl, or where it is not justified for any other reason, taking into account the interests of both parties, the customer will have the right, without limitation to legal rights, to terminate the contract or reduce the amount and, where applicable, compensation for damages and reimbursement of expenses. However, there is no right to terminate the contract if the defect is purely insignificant in terms of quality. The consumer can ask, at his choice, the seller to repair the goods or replace them, without expenses in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other. Any repair or replacement must be completed by ARTEX by GREEN LINE S.r.l. within a reasonable period of time and without any significant inconvenience to the customer, taking into account the nature of the goods. The consumer can request an appropriate discount on the price or the termination of the contract if: a) repair or replacement is impossible or disproportionate; b) ARTEX by GREEN LINE S.r.l. has not remedied within a reasonable period of time c) ARTEX by GREEN LINE S.r.l. did not complete the remedial action without causing a significant disturbance to the client. It is understood that the customer does not have the right to request the termination of the contract in the event that the non-compliance is minimal. ARTEX by GREEN LINE S.r.l. will cease to be responsible in the event that the customer personally modifies the goods or has it modified by a third party without having obtained the consent of ARTEX by GREEN LINE Srl, unless the customer proves that the quality defects in question have not been caused neither in whole nor in part by such modification and that such modification does not make the subsequent execution more difficult. ARTEX by GREEN LINE S.r.l. is not responsible for quality defects resulting from normal wear, external impacts or incorrect use. Times and methods of exercise of the Legal Guarantee The Customer must send a written communication to ARTEX by GREEN LINE S.r.l. (for convenience the "Contacts" section can also be used) or contact ARTEX by GREEN LINE S.r.l. by phone at 0733850112, indicating the product defect. Wait for the Return Authorization Number (NAR) identifying the file to be communicated by ARTEX by GREEN LINE S.r.l. Prepare the product for shipment by carefully packing it and enclosing all accessories, the instruction manual and all the contents originally in the product packaging; indicate on the packaging the Return Authorization Number (NAR) assigned by ARTEX by GREEN LINE S.r.l .. The transporter will contact the Customer to agree on the withdrawal of the product (the customer's unavailability by telephone will delay the collection of the product).

12. Additional guarantee

Some products sold on the Site, in addition to being covered by the Legal Guarantee, are covered by the additional Guarantee. The additional 1 or 3 year warranty is added to the legal guarantee of 24 months in any case due to the right of the consumer, under the conditions established by law. 14. Retentione of title

ARTEX by GREEN LINE S.r.l. will remain the owner of the goods until full payment of the amount due. In the event that the customer does not pay in full the amount due, ARTEX by GREEN LINE S.r.l. will have the right to terminate the contract once a reasonable additional time period established for payment has passed without success. At the time of termination, ARTEX by GREEN LINE S.r.l. will collect the goods and, depending on the case, may request the customer to transfer to ARTEX by GREEN LINE S.r.l. all rights to redeem the goods against third parties.

15. Jurisdiction

For the resolution of any civil disputes arising from the interpretation, execution and termination of this distance selling contract if the Customer is a consumer (ie a natural person who purchases the products not for purposes related to his professional activity) the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer himself if located in Italy (Art. 66-bis Legislative Decree 21/2014). If the customer is not a consumer, the exclusive jurisdiction will be attributed to the Court of Ancona.
